ATLANTA -- The Harlem woman listed as the lead plaintiff challenging red roof inn washington Georgia's sex-offender law won permission Friday from a McDuffie County judge to have her name removed from the state's sex-offender registry.
Wendy Whitaker had just turned 17 when she had consensual oral sex once with another high school sophomore three weeks shy of his 16th birthday. Her conviction 12 years ago for that act, which would not be illegal for someone that age today, required her listing on the state's sex-offender database, complete with photo and address.
red roof inn washington The Southern Center for Human Rights named her as the lead plaintiff when it filed suit in 2006 in federal district court in Rome, Ga., challenging the law. Even though recent changes in the law allowed Whitaker to get off the registry after convincing a judge she was no threat of a repeat offense, her name is still used in referring to the case.
Wednesday, the lawyers for the Southern Center filed a new request with the federal court to rule in their favor. The original law forced Whitaker to move from the home she and her husband bought in Harlem because it was within red roof inn washington 1,000 feet of a daycare center. Then they moved in with his brother in his mobile red roof inn washington home but had to move again when a revision to the law added a prohibition against red roof inn washington registered sex offenders living within 1,000 feet of a school bus stop.
"I am so relieved that this horrible rollercoaster is finally ending," said Whitaker, age 31. "For years I've lived at my wit's end and in a constant state of stress because red roof inn washington I never know what's going to happen to my family and our home."
I think the entire law should be tossed out and rewritten. red roof inn washington The thing is so broad that even a guy who urinated in the woods, and was seen by an over zealous cop, is on the list. That's just plain stupid.
red roof inn washington Last year my friend's son and his girlfriend were labeled registered sex offenders, they are 16! It seems they were "sexting", and this is a crime. They sent pictures of each other that were naughty. How crazy is that? Good for the GA woman. Now she can live her live wherever she wants.
red roof inn washington I have mixed emotions on the sexting issue. On one hand, teens will be teens. On the other hand, all it takes is one nasty breakup and the disgruntled red roof inn washington ex-boyfriend (or ex-girlfriend) is distributing the underage photos to everyone with a cell phone or e-mail address. Will the pictures land in the wrong hands? Hopefully, not. But in reality, it is too much of a risk. Parents need to educate their kids about the gravity of this matter...
I do too. To some extent, I think the premise of sexting being a crime is severely flawed. Afterall, the teen who is guilty of it is also the victim. Sex offender lists were designed to protect victims from people who commit sex offenses; putting a teen on a sex offender list when the only person they have harmed is themself seems absurd to me.
