I am in the process of setting up a Tour Operator in the UK, specialising in South America.  I am hoping to contract services direct from small specialist suppliers in South America, as well as through DMCs, depending on the type of tour.
The problem is that I am currently applying for liability insurance to cover my UK business but all the insurance underwriters insist european bike tours that local operators have their own liability insurance.  After a recent trip to South America I have found that most of the suppliers I was hoping to work with do not have this insurance.
I'm not the first person to want to contract smaller local companies, so I wonder what is the way around this?  An additional insurance perhaps to cover those operators which do not have their own policies?  Or maybe its enough if the operator is contractually bound to accept responsibility?
Not only will you have responsibility for the safe provision of the tours, locally, but you are going to have to keep going back to South America and checking that they are complying with various provisions (e.g. by checking maintenance records of vehicles used, that kind of thing)
That said you should also check that your ground handlers/suppliers have insurance in place and get them to agree to a code of conduct/service level etc to ensure that you are not exposed as soon as your clients leave the UK as the onus will be on you as that is who the clients have their contract with.
Yes, I will be selling the tours in my name and definitely need liability insurance.  I was concerned that I could not take out the insurance myself if all my suppliers did not also have it, however I will contact specialist Travel company insurance european bike tours brokers about this.
